Terms of sale

These terms apply when you buy a photo book from Memry as a consumer. Please read them before you order, especially the section on the right of withdrawal.

1. Seller

The seller is Memry AS, org.nr. 937 614 667, Øvre Kråkenes 17, 5152 Bønes, Norway. Email hei@heymemry.com, phone +47 91 52 14 89. We are referred to as “Memry”, “we” and “us”, and you as the buyer as “you”.

2. The agreement

The agreement consists of these terms, the information given in the order and the order confirmation. Anything specifically agreed in the order takes precedence over these terms.

The agreement is binding on both parties once payment is completed. Norwegian law applies, including the Consumer Purchases Act, the Cancellation Act and the E-Commerce Act. These terms do not limit your statutory rights.

You must be 18 or older to order. If you are younger, a parent or guardian must place the order.

3. The product

A Memry photo book is printed and bound from your photos, your text and your choice of format, binding and layout. The preview shows the content and placement as it will be printed.

Colours on paper never look exactly like on a screen. A normal difference between screen and print is not a defect.

4. Price and shipping

The price depends on binding and number of pages, and is shown before you pay. Prices are total prices in Norwegian kroner.

Shipping is added to the price of the book. You choose a shipping method at checkout, where the shipping price is shown before you pay. There are no other fees.

5. Payment

Payment is handled by Stripe, by card, Klarna or other methods shown at checkout. We do not store your card details.

The amount is charged when you order, because the book is made to your choices and goes into production right away. If you pay with Klarna, Klarna's terms also apply.

6. Production and delivery

The book is printed by our production partner and shipped to the address you provide. We deliver within Norway. The delivery time for the shipping method you choose is shown at checkout.

The risk for the book passes to you when it is delivered. If delivery is delayed, contact us. You then have the rights set out in chapter 5 of the Consumer Purchases Act.

Check the address before you pay. If the book is returned because the address was wrong or the parcel was not collected, we can ship it again for a new shipping fee.

7. Right of withdrawal

The right of withdrawal does not apply to Memry photo books. The book is made from your own photos and choices and is clearly personalised (section 22 (c) of the Norwegian Cancellation Act). By ordering, you confirm that you are aware of this.

If you made a mistake in your order, contact us as soon as possible. If the book has not gone to print yet, we can often stop it and refund you, but we cannot promise this.

8. Defects and complaints

If the book has a defect caused by us or the printer, such as printing or binding errors, missing pages or damage in transit, you can make a complaint. Let us know within a reasonable time after you discover the defect. The deadline is two years from when you received the book (section 27 of the Consumer Purchases Act).

Send your order number and photos of the defect to hei@heymemry.com. We will print a new book at no cost to you. If that is not possible, you get a price reduction or a refund.

It is not a defect when the book is printed as it looked in the preview. This includes typos in text you wrote, photos with low resolution or blur, and cropping you saw before ordering.

9. Your photos and text

You must have the right to use the photos and text in the book. You are responsible for the content not infringing the rights of others and not being unlawful. We may decline to print a book with unlawful content, and will then refund you.

We use your photos only to make and deliver your book. The privacy policy explains how they are stored and deleted.

10. Personal data

We process the information you give us in order to deliver your order. Read more in the privacy policy.

11. Disputes

If you are not satisfied, contact us first at hei@heymemry.com. We will try to find a solution together with you.

If we cannot agree, you can complain to the Norwegian Consumer Authority (forbrukertilsynet.no), which can mediate. The case can then be brought before the Consumer Disputes Commission (Forbrukerklageutvalget).
